Previously unseen footage of Charlie Kirk’s fatal shooting leaves judge visibly shaken

The courtroom fell into a heavy, suffocating silence this week as a graphic, previously unreleased video captured the final moments of political figure Charlie Kirk. The impact of the footage was immediately visible on the bench: Utah State District Judge Tony Graf appeared visibly shaken, wincing as the tape played during a high-stakes preliminary hearing in Provo.

The graphic screening came during a critical five-day hearing where prosecutors are attempting to establish probable cause against 23-year-old Tyler Robinson. Robinson faces seven felony charges, including aggravated murder and obstruction of justice, in connection with the fatal shooting. He has not yet entered a formal plea.

The Mountain of Evidence

The state’s case hinges on a vast reservoir of evidence aimed at proving Robinson was the lone gunman on September 10, 2025. On that evening, Kirk, 31, was shot in the neck while addressing a crowd at a Turning Point USA rally hosted by Utah Valley University.

To secure a trial, prosecutors are introducing a multi-layered digital and physical paper trail, which includes:

  • The Graphic Exhibits: Three highly sensitive, visual exhibits detailing the logistics of the shooting, including the newly revealed courtroom video.

  • Surveillance Footprints: Security camera footage that tracking teams place Robinson at Utah Valley University both immediately before and after the assassination.

  • Forensic Ties: DNA evidence recovered from the specific rifle investigators believe was utilized in the attack.

  • The Paper Trail: A recorded statement from Robinson’s roommate and a highly incriminating, handwritten note recovered by detectives that allegedly reads: “I had the opportunity to take out Charlie Kirk, and I took it.”

  • Digital Confessions: Intercepted electronic messages exchanged between Robinson and his partner, Lance Twiggs, in which prosecutors allege the defendant explicitly admitted to pulling the trigger.

The defense, however, is preparing to chip away at the state’s forensic narrative. Attorneys for Robinson are expected to lean heavily on forensic ambiguities, arguing that state ballistics testing failed to conclusively match a heavily degraded bullet fragment recovered from Kirk’s body to the seized rifle.

Grief and Tension in the Gallery

The human toll of the proceedings sat heavily in the front rows of the gallery. Kirk’s widow, Erika, 37, attended the hearing dressed in black, flanked by his parents, Robert and Kathryn Kirk.

The emotional weight of the testimony quickly proved overwhelming. As a responding police officer took the stand to recount the immediate, bloody aftermath of the shooting, Erika became visibly emotional and hastily exited the courtroom. She was later seen outside the chamber doors, wiping away tears with a handkerchief and leaning on her mother-in-law’s shoulder for support.

The high-profile nature of the case was underscored by the presence of prominent political figures in the gallery, including Donald Trump Jr., who sat in attendance. Several rows behind the Kirk family sat the parents of the accused gunman.

The tension in the room stood in sharp contrast to the demeanor of the defendant himself. According to reports from The Daily Mail, Robinson was observed laughing at one point during the presentation of the state’s case, drawing sharp focus from those in the room.

The Stakes: A Potential Death Penalty

The immediate future of the case rests entirely with Judge Graf. If the judge determines that the prosecution has met the threshold for probable cause, Robinson could be formally arraigned and required to enter a plea before the week concludes. Because of the gravity of the aggravated murder charge, prosecutors have already signaled their intent to seek the death penalty if the case concludes with a conviction.

Ahead of the grueling five-day log of evidence, the Kirk family issued a rare joint statement detailing the psychological weight of the legal process.

“Charlie was a beloved husband, son, brother, friend, and father,” the family stated. “Every court proceeding serves as a painful reminder of his death and the loss that has irrevocably impacted our lives and the lives of his children. We remain deeply grateful for the support, prayers, and kindness we have received. This outpouring has sustained us during the darkest days of our lives. Out of respect for the judicial process, we will not be commenting further at this time.”
